The Planning Authority has taken enforcement action against an unauthorised industrial storage facility and illegal workers’ accommodation operating across three residential lots in Kampong Lambak, Mukim Berakas, after they were found to be in breach of Section 23(2) of the Town and Country Planning Act (Chapter 248).
The premises had been converted for industrial storage and staff accommodation without first obtaining Planning Permission from the Planning Authority.
According to the Planning Authority, the unauthorised conversion of residential land for industrial purposes is a serious breach of planning regulations as it may adversely affect the safety, health and amenity of surrounding residential neighbourhoods.
Investigations found the premises were being used to store construction materials, equipment and machinery, while also providing accommodation for workers. Industrial storage activities are only permitted in appropriately zoned industrial areas and require prior planning approval. Similarly, staff accommodation must be established only in premises approved for such use to ensure compliance with planning, safety and infrastructure requirements.
Following enforcement action, the unauthorised industrial storage activities have ceased, the workers occupying the illegal accommodation have vacated the premises, and the storage operations have been relocated to a suitable industrial area.
The Planning Authority reminded property owners, businesses and developers that any change in the use of land or buildings, including the establishment of industrial storage facilities or staff accommodation, requires prior Planning Permission under Section 23 of the Town and Country Planning Act.
Any person convicted of carrying out development without Planning Permission is liable to a fine of up to BND200,000, imprisonment for up to two years, or both. For continuing offences, an additional fine of up to BND10,000 for each day the offence continues after conviction may also be imposed.
